1.1. In these Conditions “BCP Leisure,” “Leisure Centre” or “the Council” (and pronouns to this effect including “we,” “us” or “our”) shall refer to leisure facilities managed by Bournemouth, Christchurch and Poole (BCP) Council and its authorised Staff. This includes all or any of the facilities listed below and their equipment.
- 1.1.1. Two Riversmeet Leisure Complex
- 1.1.2. Kings Park Leisure and Learning Centre, including the Kings Park Athletics Stadium
- 1.1.3. Poole Dolphin Leisure Centre
- 1.1.4. Ashdown Leisure Centre, including Poole Community Tennis Courts
- 1.1.5. Rossmore Leisure Centre
1.2. “The Hirer” (and pronouns to this effect including, “you”, “your” or “their”) shall mean the person or persons (including any Company) in whose name the booking/event is made (as stated on the application form), and who has overall responsibility for ensuring these Terms and Conditions are followed. The Hirer must be at least 18 years of age. Should the Hirer’s personal details change, please notify us immediately.
1.3. “Attendee” shall mean any person who is attending the Leisure Centre under the Hirer’s booking. This includes participants, spectators, officials or referees, and other people who are involved in the organisation of the booking/event and contractors engaged by the Hirer to deliver products or services for the booking/event.
1.4. Use of the terms “booking” or “event” are interchangeable and refer to the date/s and time/s included within a contract for any of the activities, facilities, products, or services in that agreement.
1.5. Information on Premises Licence and Public Entertainment Licences which are referenced in this document can be found on the above supplied links to the .gov website.
1.6. “Standard Operating Procedures” and “Emergency Operating Procedures.” Standard Operating Procedures are specific documents which outline how the activity or event will run including capacities, or qualification requirements and risk assessments. Emergency Operating Procedures are specific documents which outline the planned actions in the event of emergency including roles and responsibilities. E.g. in the event of a fire, in the event of a bomb threat etc.
2.1. Initial Enquiry
- 2.1.1. The Hirer must communicate at the point of enquiry, whether there are special elements to the booking to be considered. This could include but is not limited to- the use of pyrotechnics, additional decorations, entertainment equipment, inflatables. BCP Leisure Senior Management team must provide approval for this prior to accepting a booking and reserve the right to deny further requests or amendments from the initial agreement.
- 2.1.2. BCP Leisure reserves the right to deny an enquiry or cancel a booking based on a perceived conflict of interest- for example where a similar activity already being operated by BCP Leisure; the nature of the activity is likely to cause offence; or does not match with the values and standards held by BCP Council.
- 2.1.3. Where applicable, Leisure Centres which hold Premises Licence or Public Entertainment Licences will be displayed in the reception and/or Bar area. It is the Hirer’s responsibility to ensure that any activities not covered by the Leisure Centre’s licence is instead covered by a temporary licence obtained by the Hirer.
- 2.1.4. Personal arrangements including travel, accommodation or hospitality relating to an event which are arranged by the Hirer and at their own risk.
- 2.1.5. BCP Leisure cannot be held responsible if the Hirer does not receive information- sent in any format unless non-receipt is caused by our negligence.
- 2.1.6. Facilities, services, and equipment available at each venue vary. The Hirer must check for details before making a booking. It may be possible for BCP Leisure to arrange additional equipment, furniture, etc with prior notice. Notice of the required equipment, facilities and services must be requested at the time of the booking. Availability cannot be guaranteed after this time. Additional charges for extra equipment, services and facilities may apply.
- 2.1.7. The charges for the hire of the Centre shall be fixed by the Council and set out on the Official Scale of Charges form. The Council reserves the right to vary such charges without prior notice.
2.2. How to make a booking
- 2.2.1. Upon BPC Leisure’s written confirmation of acceptance to the Hirer’s signed application, the Hirer shall be bound by and shall comply with the Terms and Conditions outline here, until the conclusion of the hire.
- 2.2.2. All applications for hire of the Centre must be made in writing including the Hirer’s agreement to these terms. Following receipt of this, BCP Leisure will process the application and will respond to confirm whether the booking/s have been accepted. Until this confirmation has been issued by BCP Leisure, no booking has been made, and resources remain available for others to secure.
- 2.2.3. If the Hirer is not physically present at the leisure centre during the booking, it is expected that the Hirer will delegate their responsibility/authority to another responsible adult (18+ years old), who must be present on site for the full duration of the booking.
- 2.2.4. Bookings relate to the agreed period of hire only and the Council cannot guarantee that further continuation bookings will be available. Acceptance of one booking does not guarantee further bookings.
- 2.2.5. The Right of the Hirer to use the Centre is not transferable, and subletting is not permitted. The Hirer shall use the Leisure Centre for the purpose expressed in the booking, and for no other purpose.
- 2.2.6. These terms and conditions are a contract between the Hirer and BCP Leisure, operating under BCP Council. No other person shall have any right to enforce any of the terms.
- 2.2.7. In all public, or external communication, correspondence, posters or similar printed or digital matter, the Leisure Centre must be referred to by its full name as outlined above (Point 1.1) and any logos or other brand imagery must be signed off by BCP Leisure Senior Management prior to production/distribution to ensure compliance with BCP Council branding.
- 2.2.8. The Hirer shall comply with all requests or instructions of the Council relating to or concerning the hiring.
- 2.2.9. The hire time must include any time required to erect and/or dismantle equipment used in connection with the hiring.
2.3. VAT
- 2.3.1. Under HMRC guidelines, some applications for hire may fall outside the scope for VAT charges to be applied or may be exempt from VAT due to the nature of the service being provided. In all other instances, VAT will be charged at the applicable rate in addition to any prices quoted and will be applied at the point of invoice.
- 2.3.1.1. Standard VAT: VAT will be charged at the standard rate for all hire relating to contracts which meet the conditions for Block Bookings and any booking relating to room hire or soft play facilities.
- 2.3.1.2. VAT Exempt: Contracts that relate to the supply of swimming teachers or other educational delivery will be VAT exempt.
- 2.3.1.3. Outside the Scope for VAT: Monthly Contract Bookings or one-off bookings that relate to the hiring of sport facilities will fall outside the scope for VAT and therefore not applicable.
2.4. Invoicing and payment
- 2.4.1. All payments will be required to be made by invoice. Invoices are raised and issued in the month following the booking/s taking place.
- 2.4.2. If applicable, VAT is applied at the point of invoice.
- 2.4.3. Failure to pay within the agreed terms may result in legal action.
- 2.4.4. Any accounts in arrears will prevent further bookings being taken for any BCP Leisure site until the balance has been paid in full.
- 2.4.5. The Hirer should contact the Centre administration team if there are queries or disputes regarding charges included on the invoices.
- 2.4.6. The Hirer should contact the Centre administration team if receipt of the invoice has not been received within the month following the hire.
- 2.4.7. BCP Council Privacy Policy can be found here.
- 2.4.8. BCP Council colleagues can apply for a discount from their booking at the current rate. This is on the basis that the BCP Council employee:
- 2.4.8.1. Supplies evidence that they are currently employed directly by BCP Council
- 2.4.8.2. Is the main contact for the booking.
- 2.4.8.3. Holds a position of responsibility and has authority to make a booking within the hiring organisation.
- 2.4.8.4. This discount is not applicable if the BCP Council colleague is only affiliated with the booking as an attendee or not in a position of authority.
- 2.4.9. Customers who hold a BCP Leisure membership which include personal inclusive use of courts, pitches or other facilities may not use this benefit against Contract Bookings.
3.1. Refunds, discounts/ or credit notes will only be made at the discretion of BCP Leisure.
3.2. Part Cancellations
Examples of Part Cancellations:
- Removing one date of hire from a monthly contract which contains four dates.
- Reducing the duration on a date from 2 hours down to 1 hour
- Reducing the facilities required on the date from two courts down to one court.
- 3.2.1. Must be made in writing to the BCP Leisure Admin Team.
- 3.2.2. One part cancellation can be accepted per contract or per calendar month (whichever is less)
- 3.2.3. If 10 or more days of written notice is given, then the Hirer will not be required to pay for the part cancellation, up to a maximum of 20% of the contract value.
- 3.2.4. If less than 10 days written notice is given for a part cancellation, the Hirer shall pay to the Council the full amount of the hire charge unless a replacement booking is obtained for equal or greater value.
- 3.2.5. For additional part cancellations in the same calendar month, the Hirer will be charged the contracted rate unless an equivalent replacement booking is obtained for equal or greater value.
- 3.2.6. Part cancellations will not be permitted if it relates to the to the supply of products, services or other unrecoverable costs incurred by BCP Leisure in the delivery of the Hirers booking. For example, purchase of supplies, consultants, or specialist equipment.
- 3.2.7. The Council is not obligated to market or promote any availability that arises from a cancellation.
- 3.2.8. Charges may be waivered for any outdoor facility which is cancelled by the Hirer, where the Leisure Centre is located within an area covered by:
- 3.2.8.1 an official weather warning, rated at amber or greater.
- 3.2.8.2 official advice from government as “not to travel” or “essential journeys only.”
3.3. Full Cancellation
- 3.3.1. If the Hirer wishes to cancel a contract in its entirety or the remainder of a contract, they must do so in writing to the BCP Leisure Admin Team.
- 3.3.2. In this event the Hirer shall pay to the Council the full amount of the hire charge due until the end of the contract- unless a replacement booking is obtained at an equivalent or greater value including covering any unrecoverable costs incurred by BCP Leisure in relation to the supply of products, services or commitments to third parties.
- 3.3.3. The Council is not obligated to market or promote any availability that arises from a cancellation.
3.4. The Council reserves the right to cancel any booking or to close or prohibit the use of the Centre or any facilities, at its discretion. Refunds or discounts resulting from this are at the Council’s discretion.
3.5. The Council reserves the right to cancel or rearrange bookings to stage tournaments, competitions, or other special events, or to allow for repairs or renovation works to be conducted to the Leisure Centre, or in the event of a civil emergency or other unforeseen circumstance.
3.6. The Council shall not be liable for any expenditure incurred or loss sustained directly or indirectly by the Hirer or any other person arising from any booking that is cancelled.
3.7. Should the Hirer be in breach of any of the booking terms and conditions (i.e. not following BCP Leisure healthy and safety policies), BCP Leisure reserves the right to cancel the booking and ban the Hirer from making any further bookings.
4.1. Provision
- 4.1.1. Except for where permission has been granted by BCP Leisure, the Hirer will not be permitted to sell any items of food or drink during their booking. Only food and drink purchased on the premises may be consumed on the premises. Permission may be granted for specific events where the requirements cannot be met by the Leisure Centre. This should be agreed in writing with the BCP Leisure Senior Management team in advance.
- 4.1.2. For bookings/events which include BCP Leisure providing catering, the Hirer must confirm numbers or any special requirements no less than 2 weeks prior. Catering is not guaranteed if this information is not provided on time.
- 4.1.3. If permission is not granted, any person who attempts to bring in food and/or drink from outside the premises will be removed from the event and refused re-entry.
4.2. External Catering
- 4.2.1. If permission has been granted for food or drink to be brought onto site, the Hirer has overall responsibility for the safe storage, handling, preparation and serving of all items and will ensure food hygiene and HACCP processes are followed.
- 4.2.2. The Hirer is responsible for providing correct information and that Food Standards Agency processes are followed including with regards to catering for those with allergies.
- 4.2.3. BCP Leisure accept no responsibility for food brought onto the premises.
4.3. Cleaning and Corkage Charges
- 4.3.1. BCP Leisure reserves the right to add a cleaning surcharge for any external catering and/or corkage fee.
4.4. Alcohol and Licensable Activities
- 4.4.1. For all bookings/events that are serving alcohol; final sales must be made 30 minutes prior to the booking/events finish time.
- 4.4.2. Any drink not consumed by the end of the event will be disposed of.
- 4.4.3. All activities will operate within the restrictions of the premises licence or temporary licence and in line with the law.
- 4.4.4. The Hirer must be familiar and comply with regulations on other licensable activities which may apply to their intended booking including, but not limited to lotteries/raffles, use of recorded or live music, indoor sporting events including boxing or wrestling.
5.1. Due to high demand for facilities at certain times, we cannot guarantee access to all facilities immediately.
5.2. Operational hours are subject to change, with variations across centres and facilities.
5.3. Subject to agreement, bookings take place outside of the normal operational hours for a facility. Any such hire will include additional costs incurred by BCP Leisure in extending the operational hours.
5.4. Cleanliness, Alterations and Damages
- 5.4.1. All areas must be left clean, tidy, and free from damage. Any additional cleaning, waste removal, repair, or necessary replacement undertaken by BCP Leisure because of the booking/event shall be charged to the Hirer via invoice.
- 5.4.2. The Hirer shall ensure that no alterations whatsoever are made to the Centre’s structure and that no apparatus, equipment or decorations be fixed or fixings made without the prior written permission of the Council.
- 5.4.3. No structural or other alterations shall be made to the fabric of the building or any furniture fixture or fittings without written permission from the events manager.
- 5.4.4. No banners, leaflets or posters shall be placed within the boundaries of the Centre without the approval of the BCP Leisure Senior Management team.
5.5. Equipment
- 5.5.1. The Hirer and any attendees are responsible for their own personal property. Please be familiar with our Lost or Abandoned Property Policy- available from each site.
- 5.5.2. No equipment can be stored on site without the written consent of the BCP Leisure Senior Management team and this may be subject to a charge. The Hirer shall be liable for any additional expenses incurred by BCP Leisure if the booking/event overruns.
- 5.5.3. Any electrical equipment bought on to the site must be PAT tested in advance to ensure that it is electrically safe as per legal guidelines.
- 5.5.3.1. The electrical item must display a current PAT test ‘pass’ sticker and a copy of the certificate/report from the tester must be supplied to BCP Leisure prior to the booking taking place. If the electrical item’s PAT test expires during the period of hire, the Hirer must supply BCP Leisure with renewed certificate/report prior to using the appliance again.
- 5.5.3.2. Use of any electrical equipment can be ceased by a BCP Leisure Duty of Senior Manager if, in their reasonable opinion, the item is deemed not to be safe.
- 5.5.4. No chemicals or other substances may be brought on to BCP Leisure sites or stored in any otherwise agreed equipment storage area without the written permission of BCP Leisure Senior Management. For any agreed chemicals or other substances, a COSHH assessment must be completed, maintained and a copy included in the centres COSHH register.
5.6. Noise
- 5.6.1. Noise levels will be kept at a level which is acceptable and the Hirer will reduce noise levels immediately if instructed by a BCP Leisure employee.
- 5.6.2. The Hirer must ensure that all booking/event attendees show consideration towards residents living near the Leisure Centre – particularly during early mornings or late evenings.
5.7. Participants & Attendees
- 5.7.1. The Hirer must ensure that appropriate clothing is worn for all activities. Outdoor shoes must not be worn on poolside or in wet side changing areas. Non marking soles must be worn in all activity areas.
- 5.7.2. All regular attendees should have a BCP Leisure access card issued to them to gain entry via the access gates (in applicable sites). The card may only be used by the named person and in accordance with Terms and Conditions. Lost cards incur a replacement fee, to be paid via Reception. Non-regular attendees or those attending at a site without an access gate system, must check in at Reception on arrival before proceeding to the activity.
5.8. Travel arrangements
- 5.8.1. The Hirer and any attendees must abide by all car parking policies including pay & display charges, disabled parking, and access for tall/wide vehicles.
- 5.8.2. The Hirer and any attendees must ensure that bicycles or scooters are secured outside building in the appropriate place. We encourage the use of police approved ‘D Locks’ to maximise security but accept no responsibility for loss or theft.
6.1. Hirers are reminded to ensure they understand their own obligations under the Health & Safety at Work Act 1974 and all other relevant legislation.
6.2. BCP Leisure reserves the right to enter any part of the facility at any time with or without a third party, without stating a reason, and may cease any activity that it deems to be inappropriate or unsafe. No refunds or discounts will be applied.
6.3. The Hirer and attendees must comply with these conditions of use, have regard for the safety of, and behave considerately towards other users, members of the public, colleagues, the building, and equipment. Any person not doing so may be asked to leave the Leisure Centre and must do so immediately. The Hirer is responsible for the behaviour of any children attending the Leisure Centre and must explain any relevant rules and conditions to them. Notices and signs on display in the centre must be complied with.
6.4. Pool Safety
- 6.4.1. BCP Leisure will provide trained and qualified lifeguards for all pool bookings, and this will be charged accordingly. There may be exception to these rules by prior, written agreement by the BCP Leisure Senior Management team.
- 6.4.2. Bookings which include use of the pool facilities will also ensure that the Pool Rules are adhered to.
6.5. Use of Fitness Facilities
- 6.5.1. Bookings which include accessing the Gym or other fitness facilities with participants who are aged 11-15-year-olds must either include the hire of a suitably qualified BCP Leisure Gym Instructor or Personal Trainer, or all the following must apply:
- 6.5.1.1. 1 adult (18+) must be present and actively supervising to a maximum of 4 11–15-year-olds.
- 6.5.1.2. Each adult supervisor is strongly recommended to attend a BCP Leisure Gym Induction prior to providing supervision.
- 6.5.1.3. Each child aged 11-15 years old must attend a BCP Leisure Gym Induction prior to their first session.
- 6.5.1.4. 1 adult (18+) must hold a minimum of Gym Instructor Practitioner or Personal Trainer Practitioner level of qualification, with child specific CPD endorsements for Working with Children Professional Standard. This person must be present and overseeing for the entire duration of the booking. See guidance here from UK Active.
6.6. First Aid and Accidents/Near Miss
- 6.6.1. If competitions or tournaments are to take place outside ‘normal’ opening hours, the Hirer shall arrange to have appropriate First Aid provisions in place. BCP Leisure will provide a qualified first aider on site for the duration of the booking/event however for large scale events or where there is an enhanced risk of injury, additional First Aid provisions must be arranged by the Hirer. This will be dependent on the type/size/duration of the booking/event.
- 6.6.2. Any accident, incident or ‘near miss’ must be notified to the Duty Officer as soon as practically possible and before the Hirer leaves the premises. This information will be recorded on the relevant BCP Leisure form. In the event of the Hirer not being physically present on the date in question, the delegated responsible adult must ensure that this is completed.
- 6.6.3. If the Hirer is made aware of an accident, incident or ‘near miss’ after the booking has taken place, the Hirer must inform the Centre immediately, including contact details of the person/s involved.
6.7. Risk Assessment and Operating Procedures
- 6.7.1. The Hirer is responsible for ensuring that the activity being delivered is suitably risk assessed prior to commencement and that Standard Operating Procedures and Emergency Operating Procedures are in place as applicable. Risk assessments must be submitted to the BCP Leisure Senior Management team to be stored on file until 31 March annually. You must update the centre with any changes during this time.
- 6.7.2. BCP Leisure will provide the Hirer with relevant sections of the Normal and Emergency Operating Procedures as required.
- 6.7.3. BCP Leisure operates under UK Active and promotes the Health Commitment Statement for all participation in physical activity. 6.8. Safeguarding
- 6.8.1. It is expected that any Hirer who is interacting with children, young people or vulnerable adults will have a suitable safeguarding policy in place. BCP Safeguarding policy can be found here: Corporate Safeguarding Strategy
6.9. Security
- 6.9.1. If the booking/event is a ticketed or an open public event, the Hirer must provide Security Industry Authority (“SIA”) qualified security. The numbers of security personnel will vary based on the event and venue. Failure to provide sufficient SIA security may result in cancellation of the booking/event.
6.10. Fire
- 6.10.1. The Hirer must ensure that attendees are adequately aware of what to do should the fire alarm sound at the Leisure Centre, including where the nearest fire exits are and where the designated meeting point is. All instructions given by BCP Leisure team must be complied with.
- 6.10.2. Fire exits and means of escape must not be obstructed and not used as a method of entry or exit to the facility.
- 6.10.3. For bookings/events attracting or likely to attract large attendee numbers, a maximum number will be enforced based on the fire risk assessment and Operating Procedures. This capacity must be strictly adhered to.
- 6.10.4. No gas canisters or open flames are permitted on site.
7.1. Prohibited Items and Activities
- 7.1.1. The following must not be brought into the premises without the prior written permission from BCP Leisure Senior Management team 1. Crockery & glass, 2. Animals (except registered assistance dogs), 3. Food/drink/retail items, 4. Electrical equipment, 5. Hazardous substances.
- 7.1.2. The Hirer must not use any BCP Leisure site to: 1. Give away live animals as prizes; 2. Give exhibitions, demonstrations or performances of hypnotism; 3. Conduct activities for gaming or wagering other than lawful gaming carried out in line with the Gaming Act 1968; 4. Collect monies from attendees other than by written consent of the BCP Leisure Senior Management team.
- 7.1.3. The Hirer will not be permitted to sell any goods during their booking without express prior written permission from BCP Leisure Senior Management team.
7.2. Loss, Damage, and Insurance
- 7.2.1. In the event of damage to the Leisure Centre or damage to or loss of any facility or equipment comprising or contained in the Leisure Centre (fair wear and tear excepted) arising out of or by reason of or in connection with the hiring, the Hirer shall pay to the Council the cost of repairing and making good any such damage and/or replacing any such loss.
- 7.2.2. The Hirer shall ensure adequate insurance with a suitable Insurance Company to cover the range of activities under the contract and provide evidence to the Council upon request.
7.2.3. BCP Leisure:
- 7.2.3.1. Accepts no responsibility for the loss of, or damage to, property or injury, illness or death on its premises unless caused by its own negligence.
- 7.2.3.2. Outlines that total liability to the Hirer is limited to the fees that have been paid for the relevant booking/event and shall not be liable for any loss of enjoyment, or wasted expenditure or fees paid to the Hirer by attendees.
- 7.2.3.3. Will not accept responsibility for the safe keeping of any money or goods. The Hirer must communicate this to all attendees.
7.3. Admission and Barring
- 7.3.1. The Council reserves the right to refuse admission to, or evict any person or persons from the Centre, at its absolute discretion. The Hirer shall comply with any instructions given by the Council.
- 7.3.2. BCP Leisure reserve the right to request that any person leaves an event if that person’s conduct is unacceptable (in the Duty Managers reasonable opinion). No refund of fees or any other costs will be made in these circumstances.
7.4. Media and Marketing
- 7.4.1. Any photography or video recording must be reported to reception whereby the Hirer will be asked to complete a form for a permit to be issued by the Duty Manager on site.
- 7.4.2. The Hirer shall not grant sound, television broadcasting, or filming rights without prior written conditional consent from the BCP Leisure Senior Management team.
- 7.4.3. Consent is conditional on the basis that the content being produced or broadcasted is a fair and accurate representation and that no conflict of interest is likely to occur.
7.5. Responsibility
- 7.5.1. The Hirer shall have overall responsibility for:
- 7.5.1.1. The administration, organisation and running of the event in relation to the hire. Special arrangements can be made where the Council can give specific help, but it will not be the Council’s responsibility to run events for the Hirer.
- 7.5.1.2. The supervision and control of all attendees in the designated areas designed for the duration of the booking. Special instructions will be given by the Council depending on the purpose of the booking.
- 7.5.1.3. Ensuring that the Centre (including the changing rooms, showers, and toilets) are left in a tidy condition.
- 7.5.1.4. Ensuring that all attendees are correctly and suitably attired, especially regarding to footwear (light-soled sports shoes in the Hall) and swim wear for pool-based activities.
- 7.5.1.5. Providing PPE for attendees as outlined in the Hirer’s risk assessment. This may include helmets or wrist/knee/elbow protection, noise defenders, or eye protection.
- 7.5.1.6. Ensuring that all equipment used complies with manufacturer’s recommendation, has been well maintained and is in good working order.
- 7.5.1.7. Ensuring that any individual leading an activity is suitably qualified, experienced, and insured to deliver the activity.
- 7.5.1.8. Ensuring that there are sufficient organising persons available to fulfil these conditions.
7.6. Feedback and Complaints
- 7.6.1. BCP Leisure welcome feedback, which is used to make informed decisions about positive changes to make to the delivery of products and services. However, if the Hirer has cause for concern or complaint during a booking/event, then please speak to the Duty Officer immediately so that issues can be address at the time.
- 7.6.2. Any feedback or complaints should ideally be emailed or put in writing to the centre using the contact details below (point 9.0.) although verbal complaints will be accepted. Received complaints will be directed to the appropriate person within BCP Leisure for investigation and a response provided to the complainant (if contact details have been provided). If this method has been exhausted and the complainant does not agree that the response has satisfactorily addressed the complaint, then the BCP Council formal complaints process can be used. 8.1. We may revise our terms and conditions from time to time, for example to reflect changes in relevant laws or regulatory requirements or improvements we make to BCP Leisure events and related services.
8.2. Third party rights
- 8.2.1. For the purposes of Contracts (Rights of Third Parties) Act 1999 and notwithstanding any other agreement between BCP Leisure and the Hirer, and the contract does not give any person who is not a party to it any right to enforce its provisions. Furthermore, the rights of BCP Leisure and the Hirer to rescind or vary the terms of any contract are not subject to the consent of any other person or entity.
8.3. Governing Law
- 8.3.1. These Terms and Conditions shall be governed by and construed in accordance with the laws of England and Wales. Any disputes shall be exclusively subject to the jurisdiction of the courts of England and Wales, and the Hirer’s use of the site confirms their agreement to this jurisdiction.
8.4. Severance
- 8.4.1. If any of these terms are determined to be illegal, invalid or otherwise unenforceable by reason of the law, then to the extent to which that term is illegal, invalid or unenforceable, it shall be severed and deleted from that clause and the remaining terms shall survive and continue to be binding and enforceable.
8.5. Termination
- 8.5.1. By mutual agreement, both parties may agree to terminate the contract outside of the Cancellation policy (Point 3) without penalty.
